Language in Budget Trailer Bill Eliminates the NPS/A Audit Requirement for Certification as of July 1, 2018
The Governor signed the 2018‑19 Budget Act and 26 other budget related bills on June 27 and June 28, 2018. Included in one of the Trailer Bills, statutory amendment language eliminated the Nonpublic Schools and Agencies audit requirement, with the exception of Nonpublic Schools which are affiliated with Licensed Children’s Institutions (LCI). No Nonpublic Agencies (NPA) or Nonpublic Schools (except NPS affiliated with LCI) will have to submit an audit to the California Department of Education for new or renewal of NPS or NPA 2019 state certification.
CAPSES as the lead association, in collaboration with CalABA, CSHA, OTAC, CPTA, ABA, and COA, worked tirelessly to resolve the NPSA audit issues and either submit a bill to the California Legislature to amend the current NPSA certification requirements for an audit, or resolve the NPSA audit issues in Budget Trailer Bill language. In the final resolution, the California Legislature Budget Conference Committee adopted Trailer Bill language which was sent to Governor Brown in the 2018-2019 California State Budget. As part of the Budget trailer bill language, the amended language regarding the elimination of the audit for NPA and NPS became law on July 1, 2018 as part of the Budget.
